1. Introduction
Welcome to Capistrano Freight Logistics LLC’s messaging service. These Terms and Conditions (“T&Cs”) govern your use of the Service. By opting in to receive text messages from the Service, you agree to be bound by these T&Cs. If you disagree with any part of the T&Cs, you should not opt in to receive text messages from the Service.
2. Definitions
“Company” refers to Capistrano Freight Logistics LLC.
“Service” refers to Capistrano Freight Logistics LLC ‘s messaging service.
“User” refers to you, the individual who opts in to receive text messages from the Service.
3. Opt-In, STOP, HELP
By providing your phone number and opting in to receive text messages from the Service, you agree to receive messages from the Company. You may opt-out of receiving text messages at any time by replying “STOP” to any message you receive from us. Reply “HELP” to further assist you. Standard message and data rates may apply.
4. Content
The content of the text messages you receive through the Service is the property of the Company or its licensors. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or otherwise exploit any content of the text messages without the express written permission of the Company.
5. User Conduct
You agree to use the Service in a lawful and respectful manner. You will not use the Service for any purpose that is prohibited by these T&Cs or applicable laws and regulations.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
7. Limitation of Liability
THE COMPANY WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
8. Limitation of Liability for Carriers and Drivers
The carrier and its drivers agree that they may legally receive SMS (text) messages originating from the Company. Reading or responding a Company message while driving a truck or motor vehicle can cause serious injury, death, or property damage to you or others. DO NOT read or reply to texts unless your vehicle is stationary and parked.
9. Termination
The Company may terminate your access to the Service at any time, for any reason, without notice.
10. Governing Law
These T&Cs will be governed by and construed in accordance with the laws of the State of Texas.
11. Entire Agreement
These T&Cs constitute the entire agreement between you and the Company with respect to your use of the Service.
